    4. Payment Terms

    All fees are strictly non-refundable unless otherwise stated in writing. For subscription-based services (e.g., AI Agent hosting, ongoing ad management), payments are processed monthly in advance. Project-based work requires a deposit as outlined in your specific proposal before work commences.

    5. Intellectual Property

    Upon full payment, clients retain ownership of the final deliverables (e.g., website design, ad creatives). However, PICSOFT LTD retains the right to use completed work for promotional purposes, portfolio display, and case studies unless a non-disclosure agreement (NDA) is explicitly signed.

    6. Limitation of Liability

    While we strive to deliver exceptional results and maximize ROI, PICSOFT LTD cannot guarantee specific financial outcomes or lead volumes, as market conditions and third-party platform algorithms (e.g., Meta, Google) frequently change. We are not liable for incidental, consequential, or indirect damages arising from the use of our services.

    7. Termination

    Either party may terminate ongoing service agreements with 30 days written notice. In the event of termination, the client is responsible for payment for all work completed up to the termination date.

    8. Governing Law

    These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the English courts.
